ЗВЕРШЕННЯ ЗЕМЕЛЬНОЇ РЕФОРМИ В УКРАЇНІ ЗА КОГНІТИВНИМ ПРИНЦИПОМ ПОЗИТИВНОЇ ЧАСОВОЇ ПРЕФЕРЕНЦІЇ
Анотація
В статті з’ясовано, що антиконституційна діяльність в господарській сфері України, яка пов’язана з природокористуванням, особливо в агросфері, як причинно-наслідкова закономірність, здійснюваної дотепер так званої «земельної реформи» спричинила рух до «хаосу», в якому наглядно проявилися наслідки корупційних і олігархічних схем (мораторій, рейдерство, самоправство, безвідповідальність тощо), спонукає громадян України захищатися і діяти «тут і зараз» – на основі конституційного прагматизму. Для визначення засад розв’язання таких критичних загальнонародних завдань, автором статті пропонується обрати певний історично відомий стратегічний підхід в рамках «Концепції часової преференції», яка має своє коріння ще у 19-му столітті та була розвинута Ейгеном фон Бем-Баверком. Обґрунтовано необхідність невідкладної імплементації конституційних прав власності Українського народу на землю та її природні ресурси як абсолютне право власності – на «природні об’єкти», здійснюючи повноцінну інституалізацію чинних земельних норм Основного Закону України. Метою даного дослідження є визначення реальної консолідованої цінності «землі та її природних ресурсів», як природного непозиченого капіталу нації – основного національного багатства українського народу, шляхом формування когнітивних організаційно-економічних засад (орієнтирів). Доведено, що когнітивні земельно-економічні закони збалансованого користування природними об’єктами публічного права, що спонукатимуть до ефективного біфуркаційного стрибка розвитку країни, з метою забезпечення високого рівня життєдіяльності кожного громадянина в процесі звершення земельної реформи в Україні, як нової парадигми, – функціонуватимуть за когнітивним принципом позитивної часової преференції. Встановлено, що в існуючому гібридному середовищі деградації і протистояння розвитку держави з боку антиконституційної корупційної системи, виникла потреба в розблокуванні спротиву – в конституційний спосіб, шляхом надання негайного і справедливого офіційного тлумачення сутності чинних конституційних земельних норм Конституційним Судом України.

ACCOMPLISHMENT OF LAND REFORM IN UKRAINE ACCORDING TO THE COGNITIVE PRINCIPLE OF POSITIVE TIME PREFERENCE
Summary
The article clarifies that the unconstitutional activity in the economic sphere of Ukraine, which is related to nature management, especially in the agrosphere, as a causal pattern of the so-called "land reform" has led to a movement to "chaos", which clearly manifested itself. consequences of corruption and oligarchic schemes (moratorium, raiding, arbitrariness, irresponsibility, etc.), encourages Ukrainian citizens to defend themselves and act "here and now" - on the basis of constitutional pragmatism. To determine the basis for solving such critical national problems, the author proposes to choose a historically known strategic approach within the "Concept of Time Preference", which has its roots in the 19th century and was developed by Eugen von Böhm-Bawerk. The necessity of immediate implementation of the constitutional property rights of the Ukrainian people to land and its natural resources as an absolute right of ownership - to "natural objects", substantiating the full institutionalization of the current land norms of the Basic Law of Ukraine is substantiated. The purpose of this study is to determine the real consolidated value of "land and its natural resources" as a natural unborrowed capital of the nation - the main national wealth of the Ukrainian people, by forming cognitive organizational and economic principles (guidelines). It is proved that cognitive land economic laws of balanced use of natural objects of public law, which will encourage an effective bifurcation leap of the country's development in order to ensure a high standard of living of every citizen in the process accomplishment of land reform in Ukraine, as a new paradigm - will function cognitively. the principle of positive time preference. It has been established that in the current hybrid environment of degradation and opposition to the development of the state by the unconstitutional corruption system, there is a need to unblock the resistance - in a constitutional way, by providing an immediate and fair official interpretation of the current constitutional land norms by the Constitutional Court of Ukraine.
