ТЕОРІЯ ТА ПРАКТИКА ПУБЛІЧНИХ ЗАКУПІВЕЛЬ

Анотація

В результаті аналізу літературних джерел та нормативно-правової бази встановлено сутність публічних закупівель, яка полягає в задоволенні соціально-економічних потреб громадян у формі надання товарів та послуг за рахунок бюджетних коштів на основі відкритої співпраці представників уряду та бізнесу через систему електронних відкритих торгів. Визначено основні принципи та особливості публічних закупівель в Україні. Проаналізовано світові практики управління системою публічних закупівель, зокрема детально розглянуто процес здійснення публічних закупівель в ЄС та США. Визначено ключові аспекти формування та реалізації подальшої політики в сфері публічних закупівель, серед яких основними є синхронізація національного законодавства про публічні закупівлі з директивами Європейського Союзу та стандартами Угоди СОТ, зменшення ризику зловживань (корупції) та підвищення рівня професійного користування електронною системою закупівель всіх учасників даного процесу. Перспективним напрямом в сфері публічних закупівель для всіх учасників процесу визначено міжнародну співпрацю на основі діючої торговельної Угоди СОТ про публічні закупівлі (GPA) між Україною та країнами-членами СОТ.

THEORY AND PRACTICE OF PUBLIC PROCUREMENT

Summary

The paper analyzes the scientific sources and regulatory framework for public procurement. The essence of public procurement is revealed, which consists in the purchase of goods and services on behalf of a state body, government agency and enterprises to meet public socio-economic needs. Public procurement is necessary because the government cannot meet all social and public demands in the form of goods and services, and private (non-governmental) organizations are primarily interested in obtaining economic benefits (profits) and not in providing free or cheap public goods. . The basic principles and features of public procurement in Ukraine are determined. The characteristics of the public procurement system in Ukraine are given. It is established that all public procurement in Ukraine is currently carried out through the electronic public procurement system Prozorro at 19 accredited sites for "sub-threshold" and "above-threshold" types of procurement. It was investigated that during 2016-2019, due to the existence of the electronic public procurement system Prozorro, UAH 100 billion was saved. The world practices of public procurement system management are analyzed, in particular, the process of public procurement in the EU and the USA is considered in detail. The peculiarities and differences of world practices of public (public) procurement from the Ukrainian one are determined, the positive and negative sides of the existing public procurement systems are indicated.
The key aspects of formation and implementation of further policy in the field of public procurement are identified, including: synchronization of national legislation on public procurement with the directives of the European Union and the standards of the World Trade Organization Agreement on public procurement; reducing the risk of abuse (corruption reducing) and increasing confidence in the procurement sector; increasing the level of professional use of the electronic public procurement system for wider introduction among entrepreneurs; introduction of a system of professional training of specialists in public procurement (courses and training for individual organizations). A promising direction in the field of public procurement for all participants in the process is defined as international cooperation on the basis of the current Trade Agreement on Public Procurement (GPA) between Ukraine and WTO member countries.
