КОНТРОЛЬ У СФЕРІ ПУБЛІЧНИХ ЗАКУПІВЕЛЬ

Анотація

У статті розглянуто сутність публічних закупівель та з’ясовано їх роль для держави і суспільства. Акцентовано увагу на особливостях сучасного етапу розвитку публічних закупівель в Україні. Визначено суб’єктів, які здійснюють державне регулювання та контроль у сфері публічних закупівель, а також з'ясовано їх основні повноваження. Проведено аналітичну оцінку реалізованих контрольних заходів у сфері публічних закупівель органами Державної казначейської служби України, Рахункової палати, Державної аудиторської служби України. Визначено підстави, за яких органи казначейства не допускають здійснення проплати платежів із рахунків замовників публічних закупівель. З'ясовано що є підставами для здійснення моніторингу публічних закупівель органами Державної аудиторської служби України. Наведено дані щодо найбільш поширених видів порушень серед замовників закупівель виявлених органами Державної аудиторської служби України. Розглянуто результати розгляду скарг у сфері публічних закупівель Антимонопольним комітетом. Визначено яким чином громадськість може реалізувати контроль у сфері публічних закупівель. Висвітлено особливості реалізації громадського контролю у сфері публічних закупівель. Розглянуто специфіку реалізації контрольних повноважень правоохоронних органів у сфері публічних закупівель.
За результатами проведених у дослідженні повноважень контролюючих органів у сфері публічних закупівель та проведеного моніторингу зафіксованих порушень норм законодавства цими органами у сфері публічних закупівель запропоновано напрями вдосконалення контролю у цій сфері, які б у подальшому сприяли зменшенню порушень норм законодавства у сфері публічних закупівель. Зокрема запропоновано розширити контрольні повноваження органів Державної казначейської служби України, збільшити можливості автоматичних перевірок органами Державної аудиторської служби України, передбачити більш жорсткі умови покарання за порушення норм законодавства у сфері публічних закупівель та унеможливити уникнення покарання за них. Наголошено на необхідності організації різного роду навчань для усіх учасників публічних закупівель.

СONTROL IN THE FIELD OF PUBLIC PROCUREMENT

Summary

The article considers the essence of public procurement and clarifies their role for the state and society. The peculiarities of the current stage of development of public procurement in Ukraine are emphasised. The subjects that carry out state regulation and control in the field of public procurement have been identified and their main powers have been clarified. An analytical assessment of the implemented control measures in the field of public procurement was conducted by the bodies of the State Treasury Service of Ukraine, the Accounting Chamber, the State Audit Office of Ukraine. The grounds on which the treasury bodies do not allow the payment of payments from the accounts of public procurement customers are determined. It was found out what are the reasons for monitoring public procurement by the bodies of the State Audit Service of Ukraine. Data on the most common types of contraventions among procurement customers which were detected by the State Audit Office of Ukraine are presented. The results of consideration of complaints in the field of public procurement by the Antimonopoly Committee are considered. It is determined how the public can accomplish control in the field of public procurement. The peculiarities of the implementation of public control in the field of public procurement are highlighted. The specifics of the implementation of control powers of law enforcement agencies in the field of public procurement are considered.
Based on the results of the study of the powers of regulatory authorities in the field of public procurement and monitoring of violations of the law by these bodies in the field of public procurement, ways of improvement the control in this area were suggested and further it will reduce violations of public procurement legislation. In particular, it is suggested to expand the control powers of the State Treasury Service of Ukraine, increase the possibilities of automatic inspections by the State Audit Office of Ukraine, provide stricter conditions for punishment for violations of public procurement legislation and provide stricter punishment for them. It was emphasised on the need to organize various types of training for all participants in public procurement.
